Bucharest, Romania – December 10, 2015 – “The Initiative Committee for the Promotion of the Citizens’ Legislative Proposal for Revising the Article 48, Paragraph 1, of the Constitution of Romania” drafted a bill which clearly defines the family as a union between a man and a woman.

This legislative initiative aims to protect the future and the sanctity of the Family Institution by eliminating any and all conjectural interpretations to which the current Article 48, Paragraph 1, of the Constitution of Romania is vulnerable.

The current Article 48, Paragraph 1, of the Constitution states: “The family is founded on the freely consented marriage between spouses, their full equality and the right and duty of parents to ensure the upbringing, education and instruction of children.” In our opinion, “spouses” is too broad of a term in this context and, in order to better protect and support the birth and upbringing of our future generations, needs to be replaced.

The revised Article 48, Paragraph 1, of the Constitution of Romania, as proposed by the Initiative Committee states: “The family is founded on the freely consented marriage between a man and a woman, their full equality and the right and duty of parents to ensure the upbringing, education and instruction of children.”

Since such a revise of the Constitution is only possible if passed through a referendum, several steps need to be taken. The draft was published today in the Official Journal of Romania alongside the explanatory memorandum and the Legislative Council’s prior approval.

The next step is to collect, within 6 months, the signatures of at least 500,000 eligible to vote citizens and submit them, alongside the proposal, to Parliament. If the Constitutional Court approves it and the Parliament votes it, then the referendum to revise the Article 48, Paragraph 1, can be organised.

We believe that the family is more than just an “institution” that ensures “the upbringing, education and instruction of children.” It is first and foremost the birthplace of our future generations. To protect the future and the sanctity of the Family Institution is to protect our continuity as a nation.

“The Initiative Committee for the Promotion of the Citizens’ Legislative Proposal for Revising the Article 48, Paragraph 1, of the Romanian Constitution” was established in October 2015 and has 16 members. It is supported by “The Coalition for the Family”, an informal group with  which it shares the same values. The Committee’s aim is to unite the civil society in support of marriage, family, and Christian values.
